Terms and ConditionsWelcome to the NTVM Application. Thank you for using the products and services provided by NTVM, which are operated by Van Minh Life Co., Ltd. During the use of the NTVM Application, these terms and conditions will automatically apply to you. Please make sure that you have carefully read them before using the application. You are not allowed to copy or modify the application, any part of it, or our trademarks in any way. You are not permitted to extract the application's source code, translate the application into other languages, or create derivative versions. The application itself and all trademarks, copyrights, database rights, and other intellectual property rights related to NTVM belong to Van Minh Life Co., Ltd. NTVM is committed to providing you with the most useful and effective application possible. Therefore, we reserve the right to make changes to the application or charge fees for its services at any time and for any reason. We will not charge you for the application or its services without clearly informing you of what you are paying for. NTVM stores and processes the personal data you have provided to us in order to provide suitable services. You are responsible for maintaining the security of your phone and access to the application. Therefore, we advise you not to unlock or root your phone, as this process removes restrictions and limitations on the software imposed by the official operating system of your device. It may make your phone more susceptible to malware/viruses/malicious programs, compromise the security features of your phone, and that may mean that the NTVM Application will not function normally or may not function at all.

How we access your personal informationIf you have downloaded the NTVM Application from the App Store or Google Play, the following terms will be added and effective: When using the NTVM Application, you understand and acknowledge that we have the right to use the following system APIs to access data on your phone: (1) Read and write to the phone's contacts, (2) Retrieve your current location, (3) Write data from the NTVM Application to the memory card, (4) Access the Internet from your device. All of these accesses will only be performed with your consent. You understand and agree that, once you have granted us permission, you will have no complaints regarding this access. The NTVM Application installed on your device operates even when your device is disconnected from the Internet. NTVM does not guarantee that the data you are viewing in the application is the latest system data, so you understand and ensure that your device is connected to the network when you need to access the latest business data. You understand and agree that you are responsible for the safekeeping of the device and/or devices with the NTVM Application installed, within your control and safety. Van Minh Life Co., Ltd is not responsible for any theft or misuse of your business data due to your negligence. You must comply with the terms of the App Store and Google Play regarding their services, including their usage policies.

Third-party servicesOur browser and application may, over time, contain links to partner browser pages. If you agree to access those links, please note that those browser pages have their own privacy policies, and we do not assume any responsibility or legal liability for those policies. Please review the policies before submitting any personal information to those browser pages. The third-party services that we may use include:

• Google Play Services
• Google Analytics for Firebase
• Firebase Crashlytics
• Facebook
• Sentry
• Google
• Apple

User-generated contentUsers of the NTVM Application may post, upload, or contribute content to the service (which may include images, text, messages, information, and other types of content) (“User Content”). Customers acknowledge that any content they post on the NTVM Application (1) is owned by them and they have the right to post such information, and (2) does not violate any laws, intellectual property rights, public decency, or other rights, or contain any content without explicit written consent from NTVM or the individual/organization concerned. NTVM may, but has no obligation to, monitor, review, or modify user content. Customers are solely responsible for all user content they post. NTVM is not responsible for User Content and does not endorse any opinions expressed in any user content.

Privacy protectionVan Minh Life Co., Ltd. respects the privacy of customers and the content of their user accounts exchanged and stored on the NTVM Application. NTVM will implement and maintain all necessary internal administrative, physical, and technical measures to protect the confidentiality and integrity of customer data. NTVM commits to:

• Not actively altering the data created by customers. This does not include situations where the software system may automatically modify the size or format of the data for display and functional purposes.
• Not accessing customer data unless it is necessary to resolve technical issues or at the request of the customer, or when required to comply with legal regulations.
• Not disclosing customer data except in the following cases:
  • With the customer's consent.
  • When required to comply with legal regulations.
  • In cases specified in these Terms of Use.

However, NTVM reserves the right to proactively or automatically access information about existing accounts on the system (including name, email) for certain purposes, including:

• Sending email notifications to customers about new features.
• Contacting customers directly to provide technical support or other assistance to enhance the user experience.
• NTVM retains the right to use customer names for marketing purposes or in promotional campaigns, product introductions, or conversations with other customers or potential customers of NTVM.

Customer Data and Responsibilities of the PartiesCustomer Data refers to any information that customers submit, upload, transmit, or otherwise make available to be displayed on the NTVM Application. Customer Data includes messages, notifications, files, images, opinions, comments, links, work-related content, and all other information displayed on the app. Customer Data encompasses all information, links, and text that customers and their user accounts input into the NTVM Application. Customers have the right to use and control the data they post on the NTVM Application. NTVM provides available features that are applicable to all customers. Customers are fully responsible for all data that they or their user accounts submit to and/or send from the NTVM Application. Customers understand that NTVM does not own any data that customers upload to the app. The decision to upload any data to the NTVM Application is entirely up to the customers. However, the following content is NOT ALLOWED to be posted on the NTVM Application:

• Content that harms, harasses, or causes damage to individuals or property.
• Content related to the disclosure of fraudulent information or materials, damaging reputation, harassment, or of a sexually explicit nature.
• Content that infringes on privacy rights or discriminates based on race, religion, gender, disabilities, etc.
• Content that violates intellectual property rights or other ownership rights.
• Content that disrupts or damages the NTVM Application (not limited to unauthorized access to the app through any means of machinery or software).

NTVM has the right to disable access to Customer Data if it determines that the accessed data violates these Terms, receives a complaint from a user account, or receives a notice of intellectual property infringement and/or a notice of content that shows signs of violating the law from the relevant authorities. Customers are solely responsible for any legal consequences if they use the software in violation of legal regulations.

Disclaimer of LiabilityNTVM shall not be held liable for the issues stated herein. Certain functionalities of the app may require an active Internet connection. The connection can be through Wi-Fi or provided by your mobile network provider, but NTVM cannot be held responsible for the app not functioning with full capabilities if you do not have access to Wi-Fi and/or if you have insufficient data allowance. At certain times, we may want to update the app. The app is currently available on Android and iOS - requirements for both systems (and for any additional systems that we decide to extend the availability of the app to) may change, and you will need to download the updated versions if you wish to continue using the app. NTVM does not guarantee that the app will always be updated to be compatible with your device and/or operate with the Android & iOS versions you have installed on your device.

Dispute ResolutionAny disputes or disagreements arising between NTVM and customers will be resolved in a spirit of cooperation for mutual resolution. In the event that NTVM and the customer are unable to reach a resolution through negotiation, the matter will be settled through legal proceedings in a competent court. The court's ruling shall be binding and final, and all parties shall abide by it.

Policy Regarding ChildrenThe services and applications on this browser page are not intended for or knowingly collect any personal information from children under the age of 13. If you are a parent or guardian who is aware that your child has provided personal information on NTVM, please contact us so that we can take prompt action to address the situation.

Changes to Terms and ConditionsThese terms and agreements may be amended or supplemented by NTVM on this page at any time without prior notice to customers (or Users). In the event that one or more of these terms conflict with provisions of Vietnamese law and are declared void by a competent court in Vietnam, the invalidated provision will be modified to comply with Vietnamese law, and the remaining provisions of these Terms and Services will remain in effect.
